1. About us and these terms

We are Apex Rides Digital Limited (Company Number 15081041) of Pavilion, 81-83 Fulham High Street, London, SW6 3JW ("Apex", "we", "us", "our"). You can contact us at hello@apexrides.com.

These terms apply to your use of our website at apexrides.com and to any Apex membership you purchase. Please read them carefully before purchasing a membership. By purchasing a membership or using our website, you agree to these terms.

Your use of the Apex app itself is governed by our App Terms of Use. Our Privacy Policy explains how we handle your personal data.

We may update these terms from time to time. The version in force when you purchase or renew your membership is the version that applies to you. We will notify you of significant changes by email or through the app.

2. Apex membership

An Apex membership is a subscription that gives you access to our library of instructor-led classes through the Apex app for as long as your membership is active.

The price is £29.99 per month, or as otherwise displayed at the point of purchase. Prices include VAT.

Membership is available in the United Kingdom only. Our content is licensed for the UK, so the service will not work outside the UK and we make no commitment that it will. You must be at least 18 years old to purchase a membership.

3. Equipment

To get the full Apex experience you need a compatible exercise bike. The app connects to third-party bikes using the FTMS Bluetooth standard. We publish guidance on compatible bikes on our website, but we cannot guarantee that the app will work with every bike or device, and we are not responsible for equipment we did not supply. You are responsible for making sure your bike and other equipment are safe, properly assembled and properly maintained.

You also need a supported phone or tablet and an internet connection capable of streaming video. Mobile data charges are your responsibility.

4. Payment and renewal

You can purchase a membership in two ways:

  • Through our website. Payment is taken by our payment provider at checkout and your subscription is managed through your online account.
  • Through the Apple App Store or Google Play. Payment is taken by Apple or Google under their terms, and your subscription is managed through your app store account.

Memberships renew automatically each month and the payment method you provided is charged at the start of each billing period, until you cancel.

If a payment fails, we will retry it and let you know. If we still cannot take payment, we may suspend your access until payment is made.

5. Your right to cancel when you first sign up

If you are a consumer, you have a legal right to change your mind within 14 days of purchasing your membership.

If you cancel within that 14-day period, we will refund what you have paid, less a proportionate amount for the part of the period during which you had access to the service, calculated from the day you signed up to the day you told us you wanted to cancel. We will make the refund within 14 days of your cancellation, using the payment method you used.

To cancel within the 14-day period, email us at hello@apexrides.com or use the cancellation option in your account. If you purchased through the App Store or Google Play, you can also cancel through your app store account, and any refund is handled by Apple or Google under their policies.

6. Cancelling after that

You can cancel your membership at any time:

  • Website purchases: through your online account at any time, or by contacting us at hello@apexrides.com.
  • App store purchases: through your Apple or Google subscription settings.

Cancellation takes effect at the end of your current billing period. You keep access until then, and no further payments are taken. We do not give refunds for part-used billing periods outside the 14-day period described in section 5, except where the law requires it.

7. Changes to price

We may change the membership price. If we do, we will give you at least 30 days' notice by email before the new price takes effect, and you can cancel before it does. The new price will only apply from your next billing period after the notice period ends.

8. Changes to the service

Our class library changes over time. Classes are added and removed, and instructors and class formats may change. Features of the app may also be added, changed or withdrawn. We will not make changes that significantly reduce the overall service without telling you, and if a change significantly disadvantages you, you can cancel as described in section 6.

9. Availability

We aim to make the service available at all times, but we cannot guarantee it will be uninterrupted or error-free. Access may occasionally be suspended for maintenance, updates or reasons outside our control. We will keep disruption to a minimum and, where planned, will try to schedule maintenance at low-usage times.

10. Health and safety

Exercise carries risk. By using Apex you confirm that you are physically able to take part in indoor cycling. If you have any doubt about your health or fitness, or you are pregnant or have a medical condition, speak to a doctor before starting. Stop exercising immediately if you feel pain, faintness or discomfort.

Class intensity guidance and instructor cues are general guidance only and are not tailored to your individual health. Work at a level that is right for you.

Nothing in this section, or in these terms, limits our liability for death or personal injury caused by our negligence.

11. Using the service

Your membership is for your personal, non-commercial use and that of your household. You must not:

  • use the service, or stream or display classes, for any commercial purpose, including in a gym, studio or other business;
  • share your login details outside your household or resell access;
  • copy, record, download, redistribute or publicly perform any of our content;
  • interfere with, reverse engineer or attempt to gain unauthorised access to the service.

We may suspend or terminate your membership if you seriously or repeatedly breach these terms. If we do so for your breach, no refund is due for the remainder of the billing period.

12. Intellectual property

We own or license all intellectual property rights in the service, including the app, our classes, music licensing arrangements, brand names, class names and logos. You are granted a personal, non-transferable right to access the content for as long as your membership is active, and no other rights. You may not use our trade marks or other intellectual property without our prior written permission.

13. Our responsibility to you

If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or of our failing to use reasonable care and skill. We are not responsible for loss that is not foreseeable, or for business losses, as the service is for private use only.

If defective digital content that we supply damages a device or other digital content belonging to you, and we have not used reasonable care and skill, we will either repair the damage or pay you compensation.

We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, and for fraud. Nothing in these terms affects your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015 for digital content to be as described, fit for purpose and of satisfactory quality.

14. Other important terms

We may transfer our rights and obligations under these terms to another organisation, for example if our business is sold. We will tell you if this happens and your rights under these terms will not be affected. You may not transfer your membership to anyone else.

Each section of these terms operates separately. If any court or authority decides that any of them is unlawful, the rest remain in force. If we delay in enforcing any part of these terms, we can still enforce it later.

These terms are governed by the law of England and Wales, and you can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
